By accessing or using Mindful Body ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the App. We reserve the right to modify these terms at any time, and your continued use of the App constitutes acceptance of any changes.
2. Description of Service
Mindful Body is a fitness tracking and workout planning application that allows users to create custom exercises, design workouts and training programs, schedule workouts, execute live workout sessions with real-time logging, and track fitness progress over time. The App may also include AI-powered coaching features.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Providing accurate and up-to-date information
- Notifying us immediately of any unauthorized use of your account
You may sign in using email/password, Google OAuth, or Sign in with Apple. You must be at least 13 years of age to create an account.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the App or its systems
- Interfere with or disrupt the integrity or performance of the App
- Upload malicious content or attempt to exploit vulnerabilities
- Use automated systems or bots to access the App without permission
- Impersonate another person or misrepresent your affiliation with any entity
5. User Content
You retain ownership of all content you create within the App, including custom exercises, workouts, training programs, and workout logs. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.
6. Intellectual Property
The App, including its design, features, code, and pre-loaded exercise library, is owned by Mindful Body and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
7. Fitness & Health Disclaimer
Mindful Body is a fitness tracking tool, not a medical service.
The App does not provide medical advice, diagnosis, or treatment. Any workout suggestions, AI coaching recommendations, or exercise information provided through the App are for informational purposes only. You should consult with a qualified healthcare professional before beginning any exercise program, especially if you have pre-existing health conditions or injuries.
You acknowledge that physical exercise carries inherent risks, and you assume full responsibility for any injuries or health issues that may arise from your use of the App or participation in any workout activities.
8. Limitation of Liability
To the maximum extent permitted by law, Mindful Body and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.
9. Service Availability
We strive to keep Mindful Body available at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.
10. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service or engage in conduct that we determine to be harmful to the App or other users. You may delete your account at any time. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved through good-faith negotiation before pursuing formal legal action.
12. Changes to These Terms
We may revise these Terms of Service at any time by updating this page. The "Last updated" date at the top will reflect the most recent revision. Material changes will be communicated through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the revised terms.
